Terms and Conditions – Tagster pty ltd Outdoor Adventures

1. Acceptance of Terms

By booking or participating in any activity offered by Tagster pty ltd, you agree to be bound by these Terms and Conditions. These terms apply to all bookings, including those made via phone, email, website, or third-party platforms.

2. Ecotourism Licensing and Land Use

All activities are conducted under the appropriate Ecotourism License as required by the NSW National Parks and Blue Mountains City Council for operations on Crown and Council-managed lands.

3. Participant Responsibility

Participants must:

• Be physically fit and capable of participating in outdoor adventure activities.

• Follow all safety instructions provided by guides.

• Disclose any medical conditions that may affect participation.

4. Risk Acknowledgement

Outdoor adventure activities involve inherent risks including but not limited to weather changes, terrain hazards, and physical exertion. By participating, you acknowledge and accept these risks.

5. Insurance

Tagster pty ltd holds current public liability insurance. Personal travel or accident insurance is recommended for all participants.

6. Booking and Payment

Booking terms include:

• Full payment is required at the time of booking.

• Bookings are not confirmed until payment is received.

7. Cancellation and Refund Policy

Strict No Refund Policy Applies:

• No refunds will be issued for cancellations by participants for any reason, including illness, change of mind, or scheduling conflicts.

• No refunds will be provided for gift vouchers under any circumstances.

• Gift vouchers are non-transferable and non-redeemable for cash.

8. Weather and Rescheduling

Weather-related terms include:

• Activities proceed in most weather conditions. However, in cases of extreme or unsafe weather, Tagster pty ltd reserves the right to reschedule or modify the activity.

• If an activity is rescheduled due to weather, participants will be offered an alternative date. No refunds will be issued due to weather-related changes.

• Participants who cannot attend the rescheduled date forfeit their booking.

9. Changes by Tagster pty ltd

We reserve the right to alter or cancel activities due to operational needs, safety concerns, or environmental conditions. In such cases, rescheduling will be offered. Refunds are not provided.

10. Liability Waiver

All participants must sign a liability waiver before commencing any activity. Refusal to sign will result in exclusion from the activity without refund.

11. Gift Vouchers

Gift voucher terms include:

• Valid for 3 years from the date of purchase.

• Must be used for the activity specified.

• Cannot be exchanged, refunded, or extended.

12. Conduct

Tagster pty ltd reserves the right to refuse participation to anyone under the influence of drugs or alcohol, or whose behavior is deemed unsafe or disruptive.

13. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia.
